Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CallCoveAI platform, including the dashboard, APIs, SDKs, and related services (collectively, the “Service”). The Service is operated by First Commit LLC. By signing up or using the Service, you agree to these Terms on behalf of yourself or the organization you represent.
1. Accounts
You must provide accurate registration information and keep it current. You are responsible for all activity under your account and for safeguarding your credentials, API keys, and any tokens issued by third-party identity providers (e.g., Google). You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
2. The Service
CallCoveAI provides software that answers phone calls using AI. You configure assistants, phone numbers, and integrations; CallCoveAI orchestrates calls through providers including telephony carriers, speech-to-text, language model, and text-to-speech vendors. The Service is provided on a usage-metered basis under the pricing posted on callcove.ai/pricing.
3. Acceptable use
You agree not to use the Service to:
- place unsolicited or unlawful calls, including calls that violate the TCPA, TSR, or any do-not-call regulations;
- send commercial email through the Service to recipients who have not given prior express consent, or in a manner that violates the CAN-SPAM Act;
- impersonate any person, business, or government entity without authorization;
- solicit, collect, or process payment card data, full Social Security numbers, or protected health information through the Service;
- infringe intellectual-property or privacy rights;
- distribute malware, conduct denial-of-service attacks, or probe the Service for vulnerabilities outside of an authorized program;
- reverse engineer the Service except to the extent permitted by law;
- resell, sublicense, or white-label the Service except under a separate written agreement.
You are responsible for obtaining all caller consents required by law in the jurisdictions where your calls originate or terminate, including two-party-consent recording disclosures and any opt-in required for marketing communications.
4. Your content
You retain all rights in the content you submit to the Service (prompts, knowledge base documents, recordings, transcripts, and call metadata, collectively “Customer Content”). You grant First Commit LLC a limited license to host, process, and transmit Customer Content solely to provide the Service. We do not use Customer Content to train large language models.
5. Fees and billing
Paid plans are billed in advance; usage-based charges are billed in arrears. Charges are non-refundable except as required by law. We may change pricing on 30 days’ notice. If your payment method fails, we may suspend the Service until payment is resolved.
6. Free credits
Free credits issued to new accounts are non-transferable, expire 30 days after issuance unless otherwise stated, and may not be redeemed for cash. We may modify or revoke free credits at any time, including to address abuse.
7. Service availability and changes
We work to keep the Service available, but it is provided “as is” without an uptime guarantee at this time. We may modify, suspend, or discontinue parts of the Service. We will give reasonable notice for material breaking changes to public APIs.
8. Termination
You may cancel at any time from the billing settings. We may suspend or terminate your account for breach of these Terms, suspected fraud or abuse, or failure to pay. Upon termination we will delete Customer Content per our retention schedule in the Privacy Policy.
9. Disclaimers
THE SERVICE AND ANY OUTPUT GENERATED BY THE SERVICE ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. AI OUTPUTS MAY BE INACCURATE; YOU ARE RESPONSIBLE FOR REVIEWING AND USING OUTPUTS APPROPRIATELY. First Commit LLCDISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, First Commit LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. First Commit LLC’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO First Commit LLC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You will defend and indemnify First Commit LLC against any third-party claim arising out of your breach of these Terms, your Customer Content, or your use of the Service in violation of law.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, and the parties consent to personal jurisdiction there.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date and, where required, notified by email. Continued use of the Service after a change constitutes acceptance.
